The Feds set up an absolute minimum floor. States can create their own minimum wage, as long as it isn't lower than the federal.

DOL WHD: Minimum Wage Laws in the States. It's a clickable map that shows the rates. Kansas' is lower than the Federal rate ($2.65/hr!), so the Federal rate overrules in that case.
