My xbox does the same thing. In fact it has been doing it for about 2 years now... It hasn't really gotten much worse and I just deal with it. I'm waiting for the kinks to be worked out of the 360 (and the price to come down!) before I buy one.
No offense to you personally (or Ace and barenakedladies), but your friend's idea is illegal, unethical, and stupid. It isn't Wal-Mart's fault that your xbox doesn't work. Given that the machine is a few years old, it isn't even really microsoft's fault. Save your conscience and go buy a used xbox somewhere. Buy your next machine from Circuit City and get their protection policy if you are really that upset, but don't break the law - that's lame. It's true that you probably won't get caught during the busy holiday season, but if the threat of punishment is all that keeps you from doing things you know are wrong, you'll soon find that you reap what you sow.
