When you talk about intelligence existing outside of the laws of Biology or Physics it becomes just as mystical as a god figure.
How would intelligence manifest itself on a lifeless planet? We must be careful to not simply rename concepts of Physics.
Your critique of Empiricism is valid though. Humans aren't at all as accurate in our perceptions as many would believe.
