I'm with BoCo and Sixate on this one.
I may disagree with the reasoning behind firing/not hiring them, but if the business and/or organization has certain publicly declared values (a Christian bookstore or hospital for example)then they have a right to adhere to those values.
When those values are not policy and are not publicly declared however, they have no right to do such things.
