Considering that most likely both the US and the provisional government would make sure he could not run, I don't think there is a problem.
If he is somehow elected democratically, then we'll say, "Mr. Hussain, congratulations on your victory. You are now the president of a truely democratic Iraq, and we will be watching you to make sure it stays that way."
I don't think it's a real possibility, because of how easy it would be to keep him off the ballot.
