I agree with most of the above. You are not what would be considered an "exempt" employee in any state and are due the overtime. However, it may very well be that you are not taking the right breaks. I used to work in management before becoming an attorney and we insisted that our employees take the requisite breaks each day. Sometimes you think you are showing what a hard worker you are by avoiding the breaks, but management usually gets ticked. It's a rough life. One option is to just continue to work there and not say anything about the OT and when you quit, you can file for the OT and probably penalties...of course, like the others have said, you take your chances on the job reference...even though the employer is restricted in what they can say about your employment history, there are ways around it.
