The FIRST question should ALWAYS be..
What/How does the Constitution say/apply to this situation. If you don't know the answer to that, then you ask, "How did the founding forfathers deal with that situation?"
It's true that libs and cons don't like these questions, but they are (or rather, should be) the basis on which we have government in this country.
