There is another way to look at this:
We are engaged in a war with an enemy which has a pan-global, distributed organization. We know neither the extent nor the resources of this organization. We have no treaties or agreements with them which enable us to trust that their behavior can be anticipated. We cannot even trust then to act rationally to preserve their own lives.
Because of the unknown nature, it is prudent to not allow our intelligence efforts to be revealed during court proceedings. Given the nature of trials in the U.S. these days, it is quite understandable why the government would wish to delay having a defense attorney expose critical covert activities.
I reject the racism accusation. The enemy is a fringe element in a different culture - not the entire culture.
