I think it's great that the Bush administration is no longer able to suspend the constitution and corrode democracy itself by imprisoning people arbitrarily. Sometimes democratic principles are just so hard to live under; no wonder we're trying to give them away to Iraq. (Edit: Zing! so much for
incredible restraint; I suppose I just have the regular kind...)
Before this ruling, it's been possible to hold someone, and not let them:
a. hear the charges against them
b. question the validity of those charges
c. talk to an attorney
Even detainees who were US citizens were only reluctantly given access to the courts. Bad guy or not, everyone gets to plead their case, and hear the charges. It's called "progressive, modern democracy."
