Criminal or not, he was in charge of a company that blatantly padded the bank accounts of the "elite few" (himself included)" knowingly at the expense of employees and share holders.
If he knew about it, he's a criminal; if he didn't know about it, he is guilty of gross neglect of fiduciary duty, which also makes him subject to litigation.
Either way, his actions are indefensible, IMO.
