I have been following the sordid saga of Enron quite closely. In today's NYT, there is an interesting interview with Ken Lay. I'm going to reserve my judgement on his guilt or innocence until there is a trial, but with what he has said so far, I believe at a minimum that he is guilty of gross incompetence.
The Enron board made a fatal mistake by allowing Fastow to personally profit via the off the balance sheet accounting. An ethical corporation would not have allowed this to happen.
