Changing Chattanooga's Blue Laws
The issue came up when Bernie Frogel asked for permission to open his Chattanooga Flea Market, before noon, on Sundays. In the Chattanooga Code, Section 25-25 states: it is unlawful for "any clothing, hardware, jewelry, furniture, department or variety store, drug, grocery or milk store" to sell or open for business before 12:01.
Frogel's attorney argued antique rugs could be sold, in the flea market, on Sunday mornings, but not the antique furniture, in the next booth.
The business community seems to agree. A full 86% of over 500 businesses responding to a Chattanooga Chamber of Commerce survey wanted the rule repealed.
At Tuesday's City Council meeting, members took the first step. The ordinance to repeal all Sunday business laws passed first reading by a vote of 5-2. Councilmen Yusef Hakeem and John Lively voted 'nay,' Councilmen John Taylor and John Franklin were absent.
To take effect, the measure will have to pass second and third readings, next week.
