For him to lobby as hard as he wants against the war is also legal: even if his activities could be construed as Treasonous, such a construction would reqiure a WAR, which we are not legally speaking IN. Whatever the legality of the situation, he isn't being hauled off by any blackshirted henchmen over to Cuba or anything, so I guess the US only enforces this kind of summary justice out to foreigners.
