I worked as an Independant Contractor in another state (MA). All the contractors quit about a month after I started and I moved on to another contract job in Colorado.

I earned, I think, somewhere between 800 and 1500 dollars.

I dont have my paystubs so im not sure.

The problem, is that they company never sent me a 1099-MISC form. I have called and emailed them and wont return my calls nor email me back. They company was horrible and everyone quit...we left on very bad terms (the owner threatned to find me and kill me...yah, that bad).


So, on my tax return, I reported 1500 (best guess) gross income from them and used what I think is their business name.



Obviously, I didnt earn exactly 1500. If the company turns my earnings info to the IRS, and its not exactly what I reported, that will cause a problem right?

Part of me thinks they are purposely not giving me the 1099-MISC to be dicks, because all of us contractosr left on bad terms. I called my fellow contractors that worked up there with me and they have not recieved 1099-MISC either.

What can I do? I dont get any help from the company. Should I call the IRS and tell them what is going on? Or just wait untill they call me (and hope they never do)

If it helps, due to some additionall pilot training I had a net loss income for 2005, so I didnt owe any state or federal taxes. My gross income was under 9 thousand dollars. Should I be worried about a audit?

I discussed this with my father-in-law last night since I have a sort-of similar situation going on with a disolved partnership that I was a part of (long story). When we were talking about hypotheticals, I remembered your post. He said to talk to the IRS but to document every discussion you have. Your best guess should be OK, especially if you don't have the required documentation from the employer/contractor. The burden is on the contractor, not you, to produce the right forms, and by estimating on the high end, you should be ok. Note: none of this should trigger an audit unless you're going from a very high tax bracket down to next to nothing. Any sort of audit would pretty much be random, and if it turns out that you've overpaid, then you could end up getting a refund.

Here is an interesting column on the penalties for tax fraud. From what is says, I'd say you are far in the clear. It sounds like the worst that could happen would be an order to pay whatever extra you owe with interest.
