They Shorted me Again!
 
I work at the local McCrapholes, I am a manager there.

Last monday I worked an extra long shift, covering for a closer who was not available and working my normal shift. All in all, I worked from 3 PM until 1 AM, with a half hour break somewhere in the middle.

I got my paycheck today, and it seemed a bit short. I went into the computer, and checked what they had in the timeclock for my hours that day. They showed me clocking on at 6:10PM, out at 6:27 for a break, back at 6:57, then out at 10:41. They paid me for four hours and one minute. I am missing 6 hours worth of pay. I don't have the timeslip from that day, but I do have the printed schedule, showing when I was working, and a managers log book, with my initials in it for the closing shift.

Do I have any legal recourse here? This is not the first time they have shorted my hours, and I refuse to give up on this. 6 hours of my time there equates to at least 50 bucks, and I refuse to just let that go.

Has anyone else ever experienced anythign like this?

Have you spoken to someone or are you just assuming it was intentional?

It could have been an honest mistake.

You could get even by stealing some food but that would just be adding insult to injury.

Its probably a mistake. The payroll people have lots to go through, so human error is inevitable sometimes.

Did they tell you you were out of luck when you brought it to their attention?

Why not check with payroll or your boss to see what happened. Legal recourse should only be a last resort. I'm sure mistakes like this happen regularly and there is a procedure to be followed.

Do things in this order:

1) document everything that you know, and make wo copies of EVERYTHING, making sure that your dates/times/facts are all accurate.

2) talk to your boss or the payroll person first, showing them your documentation and question what has happened and what steps can be taken.

3) if no satisfaction comes form that, go to an external labour agency (gov't) and find out exactly what your options are after you hear what your employers have said, and take the action recommended.

These are the steps to take, although there is still no garauntee of success. However, anything else will jus tmake more work for you. Don't forget, this may lead to job loss, although I believe that there is recourse in that matter too, but do you really want to spend time with lawyers and in court.

Most of us would say no.

this is too common with some places... expecially chain stores with younger people



ask yourself if it's worth staying there as well, now that you have job experience you'll beable to find new work kinda easier

It's probably a mistake. Just show who ever does your payroll the time you clocked in out, and the proof on when you left and it should be fixed.

Of course is it isn't fixed, leave, really soon.

Now that's good advice. Funny how we are all always ready to assume the worst when mistakes often happen. However, from the way youare looking at this, it sounds like this place may have other issues and this is just the latest thing that concerns you. Always remember: you do have a choice.

What have you done the other times? Kind of a fool me once, shame on you... Fool me twice shame on me thing. Calmly bring it to the attention of your boss. If that fails, then worry about elevating it to the next level.

I am not sure if this was intentional, but I have been inteltionally shorted between one and two hours before.

In our store, the managers office holds the ISP(in store processor) Now the ISP controls everything in the store. It holds time punches, drawer counts, bank deposit amounts, etc. The ISP is also online, so a store manager or anyone with an upper management password and user ID can log in from a remote location. When someone is logging in from a remote location, you cannot see who it is, but the entire screen has a purple bar around it, and you can see everything that they are doing on your screen in the store.

I have watched someone log into the computer and start editing time punches. I have watched as someone deleted 15-20 from each day that I worked in the week. Almost everyone in my store lost between one and two hours.

The most recent mistake, if not intentional, was quite the big fuck up. I arrived at work at 15:00, went on break at 20:27, came back at 20:57, and left the store at 00:51.

Now on Friday, when I got my paycheck, I saw it was short, so I looked in the ISP to see what they had my hours as. For the day in question, they said I clocked in at 18:10, out at 18:27 for break, back at 18:57, and off at 22:41.

I should have been paid for five and a half more hours than I was

Document, document, document. Copy, copy, copy. Don't leave at the end of a day without having your proof nailed down.

Can you use people from shifts before and after you as witnesses?

Payroll is often an employer's highest expenditure, it's error-prone (especially when done by outside services), and sometimes a tool of unethical cost cutters.

Sounds like they are messing with you. They may do it to cut down on the amount of overtime they have to pay you. My past job had a policy about how much overtime you could and couldn't work. They wouldn't shave off the extra hours if you exceeded them, but you would get a talking to. I wonder if someone isn't shaving off some hours here and there to keep everyone in step with a guideline.

Have you tried talking to your manager yet? Ask him/her about the missing hours.

I think the bottom line might be, this isn't the first time a crap job decided not to pay people for all the hours they have worked. Talk with your boss, see if you can get it straightened out. But document everything, and start looking for a better job.

If it is a habit and you've seen people actually changing hours, you need to go to your local labor board, since this is highly illegal.

I once worked somewhere that the manager was taking hours here and there from people's checks to make his profit/hours ratio, and I caught onto it. I mentioned it to him that I noticed something screwy was happening to my paychecks, and I was never shorted again. Thankfully he got busted and fired for it. Talk to your boss; it could be someone doing something like that, as you mentioned. Not getting paid for the hours you work is something you should NOT accept. Other employees could be getting shorted an not know it as well.

Once I worked at a pizza place... a manager there got fired for removing minutes from employee's timecards. Like, if he saw them talking for 4 minutes, not actually in the act of laboring, he would deduct 4 minutes.

I was glad he got fired. Talk about poor workplace morale... its a pizza place, jeez.

If this is a repeating pattern then yeah, they are screwing with you. I was a McCrew back in high school days. All the managers (shift/store) liked me so I had minimal problems.

if that is true, then you should absolutely inform the Labor Board for your state. They live for that kind of stuff...

They're doing this kind of crap over at Walmart -- supervisors messing with the electronic timesheets to shave hours off employee's time. The store managers there have overhead targets that they're supposed to meet, and part of that means keeping total hours below a certain level. That's often not possible, so some managers just jiggered the timesheets to _make_ it possible. Most of the employees are too sheeplike to complain, but some have.

If it's happening at Walmart, it's at least a strong possibility the same thing might go on at McD's for the same reason. Go in with your documentation and give them the benefit of the doubt; but be prepared to escalate if things don't move along.
