Ha ha, that made made my day. She looks none too happy. It'll be interesting to see if she wins or not.

Yeah, but if in any part of the promotional materials for the contest they actually used the word "Toyota", the company is probably screwed.

What kind of rights could she have? Unless she paid to enter the contest she shouldn't be bitching about it to a lawyer. Talk about frivolous. On the bright side, she has/had a kick-ass toy Yoda! |
I heard the end result was the following:
She was pissed, so she sued....she won and they let her pick a brand new car off of a (toyota I believe) dealer lot. |

she sued - won - the hooter's involved, i believe, was placed on probation by the home office in Nebraska with the threat of losing thier franchise

If I was the judge in that case, and I felt the store had made it seem like a Toyota was the prize, I'd award her the car. Of course I'd have to hear the evidence, but if she (and others) were convinced that winning was a car, I'd award. This would not be a funny prank if you ask me.
FYI - there are a lot of other law suits getting awarded however that I'd toss out in an instance. |
Did you ever get one of those leaflets/scratch cards through the mail/in a mag, urging you to PHONE THIS NUMBER NOW (calls cost$2.50 per min)
to claim your prize. It tricks you into thinking that you have won some amazing prize...maybe its a new car....a multimedia p.c.....$20,000 cash...etc etc. But in reality, you know that you have probably won the smallest prize available. There are some pretty crappy prizes...you've probably one one of those...a pen set...a keyring etc. But you check...nope YOU have not won one of these prizes, you have won one of the prizes from the "Big Win" group. You check out the "Big Win" group, and among the car etc, you see that the smallest prize is worth at least $300!!! This is a sure thing! After all SOME of the scratch cards have to be winners...this one says that you are a "Big Win" winner....you can't lose! So you ring up, to get your prize worth at least $300. Turns out thet yep...it is indeed "worth" $300. It is a book of money off coupons...which all add up to $300. You've been ripped off. But its perfectly legal...why...because they never once told a single lie. You were mislead...but never lied to. What difference is there between this and winning a "Toy Yoda"? |
I can't believe a lawyer actually picked that case up. Must have been a slow day.
