why should they be sued because that employee was a retard, I mean while working in a wearhouse you need to be careful, he should have made sure he could make it before risking his own life and possibly others. He is just luck that no one was there.

OSHA's gonna have field day.
A.) The pallet racks were not bolted to the floor. (They collapsed to easily, from just a slight nudge)
B.) The racks were not bolted to each other. (indicated by the way they toppled each other, as opposed to supporting each other.)
C.) Those barrels were stacked closer than 10 feet to the pallet racks.
D.) There are no yellow "clear zone" forklift operating lanes marked on the floor.
E.) The operator was not belted into the forklift. (He bailed out to quickly)
F.) The operator got out of the forklift instead of staying within the confines of his safety cage. He stumbled, fell and damn near didn't get away in time.

Fortunately, there only seemed to be substantial property damage and no injuries.
