The boat in the foreground was supposed to keep clear.

"When two vessels are crossing as to involve risk of collision, the vessel which has the other on her own starboard side, shall keep clear and if circumstances of the case permit, shall avoid crossing ahead of the other vessel." -- The International Rules for the Prevention of Collisions at Sea.

But as any sailor knows, two ships in the middle of nowhere will always end up on a collision course. It's one of those Murphy's Law type of things.
