?The motor vehicle lemon Law?
Hey everyone....
Im looking for input on the lemon law or experiences with dealerships that sell a car at less the perfect performance. Im dealing with a GMC dealership in Tx, where I purchased a 2002 1500 GMC Truck last Aug. Since then my truck has been in the shop at least 8 times for a rear shutter. Between 1st and 2nd gear the truck shutters going in to 2nd gear. On the fourth visit I called GM's legal correspondence team and the regional super came down and rode with me in my truck. They felt a little bit of what I was talking about and had some Ideas and they worked on it. When I got the truck back and it still did the same thing. For the past 4 weeks I have had a computer with a button attached to it to take a digital snap shot of the engine and trans. of the truck when ever it starts to act up, I just press the button. They now have found that a speed sensor might have gone out. I turned the truck in Tuesday at 8am. Last Tuesday filled out the questioner on the Better Business Bureau website dealing with my truck. On Friday of last week someone from GM called me saying they received an email from the BBB website. They said they were going to get some paper work together and call me Friday to find out what had happened with my truck. I have 3 questions, 1) What are the usual steps that would be taken if my truck is not fixed this next time? What if they want another chance to fix it? I dont want this truck after all the problems Ive had, Id rather have my money back, which is an option under the lemon law. 2) Buying a new vehicle is suppose to be a fun thing, well this has been hell! Dealing with a new car that doesn't perform when you buy it sucks! Is there any kind of compensation they can give me if they now after a year trying to fix my truck? 3) For All of the time I have had to deal with them and the inconvience of leaving work to drop off the truck has been aggravated. Is there any kind of compensation they can give for that? Any help would be greatly appreciated! Thanks, AT |

Go to www.lemonlaw.com , on the left side of the screen, there is a block that says 'choose your state' (this site is primarily for PA and NJ), it'll give you a link to help in your state.
Let me/us know how it goes, I may be looking into the lemon law on my 2000 Focus.

Here is the Lemon Laws for all the States.
http://autopedia.com/html/HotLinks_Lemon2.html The dealership will usually try to dick you around because they don't want to have to do a buyback...........DO NOT DEAL with the salesman or sales manager. You should be contacting GM directly at this point. Get a printout of your service history from the service dept. Make sure you have every PIECE of PAPER the service dept. has given you. Tell GM you want them to but the POS back...........DON'T TAKE NO for an answer. From what you described this truck is a DEFINITE buyback. If you need help, send me a pm and I will help you out bro. Hey guys.... Thanks for replying to my questions... I recently got my truck back from the shop. The problem again was a shutter between 1st and 2nd gear. They replaced the speed sensor in the transmittion. DIDNT help at all! I sent off all the required paper work to the BBB and hopefully I will hear something back next week.
" Just to let you know, I went online to the bbb's website and filled out their Lemon forum and 2 days later GM's legal correspondants called me! I thought that was pretty clever! So when in doubt just go to the BBB's website and they will get things moving! Oh and I recieved a packed instructing me on what I had to do within 1 week from BBB as well.. Well,
GM set me up a test drive with the Regional Manager to prove there was still a problem. Meanwhile the BBB set me up an Arbitration Date. On the test ride the darn shutter didn't show up!! ( OF COURSE) So the regional rep kept saying," Since there's no problem..." This sucks.. It happens over and over and then when he gets in the damn truck it doesn't want to do it! He did offer me a vehicle replacement of any GM product for the same MSRP. Which I thought was not bad! But I look through the vehicles and not much stands out for what I want. The only one is the Grand Prix '04... But Id really rather have my money back! Any advice as to what I should do? If I go to arbitration and the shutter doesn't happen and I screwed since it is an intermitant problem. Should I try for the buy back with the arbitration or should I settle for the replacement? HELP PLEASE... AT
