I think that in this particular case the value of demonstrating to the people of Iraq that Saddam really is in US custody, and really won't be coming back in glory to judge the Ba'athist loyalist and the American collaborator, far outweighs the infringement of Saddam's Geneva Convention rights.
He's still getting a trial instead of being lashed over the muzzle of a 155mm cannon and bisected at the waist. IMHO, this is testament enough to the willingness of all involved to respect the principles of due process and the rule of law.
