The major argument to your statement is that when you were a kid and recorded the song only you had a copy and maybe a friend you gave one to.
Whereas with fileswapping it would be the same as if you made say 15,000 copies of that tape and gave one to everyone you know.
Recording copies of copywrited music has been around a long time, in fact I still have a few blank 8 Track tapes. It's the sheer quantity of the copies and relative ease of doing so that has them taking these ridiculous measures at times.
