Well we had an accident in a no-fault state, with our car only insured for liability. We got the insurance information at the accident but we did not have to contact the insurance company. The company was State Farm. I think our accident happened on a Friday or Sat evening. By Monday we got a call from them. Our car was quite old, a beater actually, and not worth much. It was totalled easily. Hubby asked if they would perhaps let us keep the car though. They were actually glad to since they'd have had to dispose of it which could have been more costly. We got (I think I remember right) about $400 for the car and sold it for another $100 I think for parts. (Just be sure you get a bill of sale anytime you sell a car - but that's another story.)
So moral of the story is - get the insurance information. If they don't contact you promptly, don't wait, contact them and their insurance company SHOULD settled with you fairly. If you don't feel like it's fair, hold out for more. We've dealt with the situation more than once. We actually held out for a year (for various reasons) one time but finally ended up with a fair amount. You don't have to worry about you insurance. They probably won't do anything if you don't have comprehensive. We have comp on one of our cars and dealt with a similar, other person at fault, situation and that is when our company paid and then get reimbursed. You haven't paid your insurance company to be your go between if you haven't purchased comprehensive so don't count on them helping you.
Also - go to a chiropractor if your neck doesn't heal up fast. State Farm paid for our chiropractor visits in that same accident and he helped our whiplash clear up VERY quickly.
You might have to get another quote for repairs on you car. Unless you have a new car they may end up totalling it because the cost of repairs might be more than the blue book value. Look up the blue book value yourself before the contact you so that you know what you're dealing with.
