i haven't been following this at all...but like kirstang pointed out, it would seem to violate the confrontation clause...and isn't there a problem with being convicted under law not in effect at the point one is charged?

As has been mentioned, the law was put in place after he was charged.

As far as the hearsay/confrontation/6th Amendment issue, the Supreme Court has ruled to allow hearsay evidence in some cases. This one will probably be tied up in appeals for years before we have a clear answer.

These days we usually go with "You gotta break a few eggs, to make an omelette". Complete BS. Don't ask me how breaking eggs for breakfast food correlates to convicting ( or killiing ) innocents in order to get the bad guys.

I'm hoping that whether he's guilty or not, that the Supreme Court overturns his conviction, and this stupid law. Well, at least the law.

Strange Famous it depends on who is looking...

    Location:
    Ipswich, UK
I wasn't really speaking about lynch mobs.

Just that the guy has an accident. It isn't difficult to arrange (if they KNOW he did it and KNOW they cant prove it)... obviously we don't want mob rule. These kind of hits are what you have a secret service for...

We all would, if we were showing our public facing moral self, proclaim that this kind of thing was disgusting.

We all sleep a bit for knowing that it happens I suspect though.

I don't know how familiar US people would be with Myra Hindley and the Moors Murders. She was basically due to get out after 30 years (she and a man called Ian Brady raped, tortured, and murdered a number of children - some of whom have still not yet been found). EU law dictated that she had to be released although UK law had given a whole life tariff (a "life means life" thing)

It would have been extremely unpopular (politicians losing jobs over it) if she had been released.

And as the issue started to come to head, she got sick, and died.

In principle, do I appreciate the state killing any citizen under any circumstances? Not really

Do I care if Myra Hindley was murdered? Not really.

Without knowing all the facts I cant say, but from what Ive seen it would be legitimate if this Peterson guy got sick and died, or got in a car wreck, of hanged himself in his cell, etc etc. I'd rather that than altering the law to catch him when the evidence doesnt match the legal standards even though they know he did it.

We should not take too lightly the debt that those who cover their hands in blood so that our own hands can remain clean take on.

(of course, the problem is when we "know" they did it, and we get it wrong...)

  5. Lord wanking Longford eh Strangely Famous. Poor Winnie went to her grave last month, after spending most of her lifetime visiting the moors at weekends and looking for her lost boy. I did think they might have scattered her ashes there as its extremely doubtful he will ever be found to be laid to rest with his mum.
Your fella will appeal, probably get a re-trial - but how long does an assumed bent cop last in prison anyway?
