Interesting Cop/Open Carry interaction on video.

You see lots of these posted that are made to putt egg on LEOs faces for not knowing or enforcing the laws properly. The cop's actions in this one are pretty stellar, and if anything the guy Open Carrying looks foolish IMO for not extending the same respect that he's getting shown by the officer.

It's refreshing to see an encounter where the officer actually knows the laws he is supposed to enforce. I'm not a fan of open carry because I want the element of surprise and I don't like attracting attention to myself, but given how the officer mentions youtube maybe these open carriers are actually accomplishing something.

However I do find it strange that the officer is former military, and I assume took an oath to support and defend the Constitution, yet he is enforcing laws that ensure citizens are forced to be disarmed in public.

Oh well, I'll just stay out of California.

Eh, as niner says, we're only there to enforce the decisions of the higher ups. The Rkba in public is still winding its way through courts so it isn't per se unconstitutional.

Also as designated by our Constitution, that's for the Judicial Branch to sort out, not a police officer making a personal call on the street.

Although Article III mentions jurisdiction "arising under the Constitution," it isn't strictly delegated in our Constitution. The Supreme Court made a power grab very very early on in our Nation's history, thus designating themselves as the ultimate arbiters of the Constitution. The tradition has been respected since. Very shrewd move.

But the legal precedent in this country is for the judicial branch to review and disqualify laws, not for law enforcement officers to do so.

As much as people whine about what cops do now, it would be exponentially worse if we also had individual officers deciding on their own what was Constitutional and what wasn't.

Newsflash: Police officer discretion, the single most dynamic part of law enforcement, isn't written into the Constitution.

That and the Constitution has little relevance given the incredible bulk of standing local, state and federal laws in existence.

Anybody that mentions the fucking Constitution in a 2011 RKBA debate might as well wear a "Don't Tread On Me" t-shirt.

Wow that first officer was unbelievably professional, I would buy that guy a beer 10 times out of 10. And the second one, frankly sends shivers up my spine.

I guess maybe we need to move this into Tilted Paranoia if we keep going down this path.

I was more referring to the accepted laws of the land as currently practiced, not personal interpretations of how they should be.
