Charges stem from fight outside Toronto bar

TORONTO -- Police have upgraded an assault charge against former Milwaukee Bucks teammates Gary Payton, Sam Cassell and Jason Caffey stemming from a fight, a prosecutor and the men's lawyer said Friday.

Payton, Cassell and Caffey are charged in connection with an altercation outside a bar April 11. They were charged with common assault, but police upgraded it to assault causing bodily harm, prosecutor Calvin Barry said.

Barry said further investigation found that one of the participants in the altercation was injured.

Payton is now with the Los Angeles Lakers and Cassell with the Minnesota Timberwolves.

They are accused of assaulting two men and two women outside a club after closing time while the Bucks were in Toronto to play the Raptors.

According to Edward Greenspan, the players' lawyer, prosecutors have indicated they will proceed with summary charges in the case, rather than more serious indictable charges.

"One of the people who made the allegation of assault at the time said that he suffered no injuries, but has now got some medical evidence that we have not seen that he did suffer some medical injury," Greenspan said, adding he believed the injury was whiplash. "There's no suggestion of serious bodily harm."

He noted that police file charges in Canada that prosecutors later review, a different system than in the United States, where prosecutors file charges as a legal decision.

"The reality is that what happened today is what the police did all on their own, which the prosecutor several months down the road will review," Greenspan said.

The maximum sentences for summary charges are 18 months for assault causing bodily harm and six months for common assault, Greenspan said.

Under the revised charges, Payton now faces two counts of common assault and one count of assault causing bodily harm, while Cassell faces one of each and Caffey a lone count of assault causing bodily harm.

Kobe doesn't give a shit about what you think of him; he has his wife to worry about. If she forgives him that's their business. He's just a guy, he's human, he fucked up. This happens every day all over the world and it has nothing to do with the Lakers.

The Lakers didn't tell Kobe to commit adultery, Kobe did. If I commit adultery, it's my fault, not my employer's fault.

Individual people make their own decisions, and those who blame "organizations" for this are just looking for a scapegoat.

Yes, yes I am. The Lakers are *my team* and don't think I'll jump ship just because some of them are normal human beings. Kobe, as you know deep down inside, is gonna walk, and YOU KNOW Payton is a hard-ass. Meanwhile, as long as we have good ol' ignorant Shaq in shape, we'll be just fine no matter who else is out there. Hell, we have our old starting role players as bench warmers now. Lakers will be just fine.

All kinds of professional athletes are real asses in person, I'd say well over half of em. I hate the Lakers too, but I mean, its like you have a personal vendetta against them.

Side note: Shaq cracks me up big time, he just strikes me as so damn stupid, like borderline legally retarded. I can just picture him yelling "SHAQ SMASH!!!!!" when he gets angry. Now, I'm not saying that he necessarily IS that dumb, he just strikes me that way, which is really funny.

I think the Spurs and possibly the Nets (depending on Mourning) are going to be the teams to beat. Too many things are going to have to fit for the Lakers. I wouldm't be surprised if the lead the league in wins, but I also wouldn't be surprised if they get into childish disputes and fall apart.

"Shaq Smash!!" That is the funniest thing I have read on this board! Can’t you just envision ole’ Shaq swinging his big, cumbersome, slow haymaker fists and screaming, "SHAQ SMASH"!
With his borderline retardation, do you think the guy has handlers? One would have to assume that they must use a blow gun with detomidine laced darts to sedate him after games. Then they must have to cage him so he doesn’t hurt himself or others?

Glad to see your spirits are still high. One thing though, normal human beings do not rape women (KOBE) or strike them (PAYTON). If this is the type of behavior you consider “normal”, I think you are in the minority. I may be myopic on this point, but I would rather support a team that has decent human beings, not adulterers or thugs that are “hard asses.”

Money can buy most anything, and we all well know that freedom can be a purchased commodity. Given the amount Kobe will be spending on his defense, the DA of Colorado hasn’t got a chance. That does not mean that Kobe is guilty, he just will not be guilty by default. Just ask Chris Webber or O.J. Simpson how the legal process works. If this was you or I Hal we would be swinging from the gallows.

Here's a little something to think about with Kobe's case. Most of the time when an athlete is accused of sexual assault it's bullshit. Most of the time it's a dumb cunt trying to cash in. That's just the way it is. There's a rather large number of athletes who have had a crazy money hungry broad do this. I doubt he did it. He can get 10 different supermodels each night to do whatever he wants. He's not gonna rape someone. He has way too much to lose and she has everything/$$ to gain. We'll find out more when we actually hear the evidence.

I can't wait until next June when I can start a thread with the title....

Kobe undoubtedly can have almost any woman he desires. I agree with you on that fact. The only difference is that rape does not revolve around sex. Rapists want control, domination (something the Lakers had none of last year), and power over their victims. I disagree that this 19 year old should be ridiculed and called a “cunt”. Have some respect.
Kobe playing basketball should be secondary to his conviction charges, but it seems to me that you would much rather bombard the accuser and slip this whole issue under the rug just so he can play next season.

I can just see next June when I start a thread with the title……

The Lakers will…….Start a rapist, whom slipped a conviction due to the general public’s ignorance

Where did sixate call HER a cunt? Also, please show us your 'more than a reasonable doubt' evidence that Kobe is guilty. The fact of the matter is no one here knows for sure what happened either way. In fact, the girl should get some degree of scrutiny. I heard a detective on a radio show today claim that 'well more than half' of all rape accusations that are reported are simply lies or not anything like rape. It is unfortunate that these people ruin it for the real victims (this girl included if she is telling the truth), but that is the way it goes, you can't overlook that.

mr ignorance, I think it's funny you call me ignorant because I don't think he raped the chic. How is me believing he's innocent any different than you thinking he's guilty when neither one of us has heard any of the evidence that they have?

If it turns out this is a bogus case, which most likely it is, I'll call her a stupid drunken attention whore of a cunt that should be locked up herself for lying. It has happened before. The woman that accused Michael Irvin was put in jail for lying her ass off.
