The only restriction a private employer has on its employees is confidential information about how they do business, trade secrets, and private info. But you can't fire someone for speaking out about proposed ideas and projects. How are you ever going to get diversifying and quality ideas, constructive criticism is good for business. In college, I majored in business (finance, specifically) and groupthink was never an idea that was hailed good for business by our professors or textbooks. Asking questions and asking your employees no matter how far down the ladder are valuable to getting a well-round of good ideas.

Hasn't this already been resolved here?

I am under the impression that it was agreed upon that the employer was acting within their rights.

Whether you (or I) agree with those rights is a different issue.

No, a business CAN fire someone for speaking out... it's not SMART, but they CAN.
