Secondly: for him to lobby for a standing foreign power is perfectly legal. For him to lobby as hard as he wants against the war is also legal: even if his activities could be construed as Treasonous, such a construction would reqiure a WAR, which we are not legally speaking IN. No Declaration = No War.

Please reread Article 3 § 3. Notice the "or". You most certainly CAN commit treason while the US is NOT "at war". All you have to do is adhere to the enemies of the US, or give them aid and comfort.

You seem genuinely interested in the Constitution. Might I suggest that you call up the local community college and see if they have a basic course on the Constitution that you could take? Education is a wunnerful thing...

Whatever the legality of the situation, he isn't being hauled off by any blackshirted henchmen over to Cuba or anything, so I guess the US only enforces this kind of summary justice out to foreigners.

You're kidding yourself if you don't think he's under tight surveillance....wiretaps, cameras, the whole enchilada. Why arrest him when you can let him lead you to other subversives?
