Even in a domestic law enforcement context, the Miranda warnings are really not a requirement. It is not illegal for a law enforcement official to arrest your or me without reading this warning.
What that would mean, though, is that anything we say is NOT admissible in a court of law, because we haven't been informed that this is the case. So as Holder says, it really doesn't matter, because we don't need any additional evidence on Bin Laden. We have plenty of untainted evidence already (or at least, whatever additional info we might get from him would not be significant in the face of what we have). Personally, I think there'd be something poetic and uplifting about reading him his rights and bringing him in like a common criminal, but I would agree with Holder that it's kind of a trivial point. |
