Work related injury.
I had started to write a long post about how I was injured and all about the assholes I used to work for, but it was going to be a long boring post with the stuff like "those bastards" and "those assholes" all the way through it.
So my questions are: How long after you've been injured at work do you have to file a suit? (It's been three years) And let's say you didn't file for workman's comp. right after you were injured, but instead filed on your insurance because you felt as though you would be fired if you filed for workman's comp. Basically, what are my options? |
If you have documentation, then you might have a case unless you've passed the statute of limitation. You might have to talk to a laywer to find out if the laws favor you or not, particularly in your state.

Well the doctors should have documentation. And I've made an appointment to speak to a lawyer next week.

Dude, 3 years? I think you're gonna be screwed. At least in Ohio, unless you have documentation, they don't cover shit afer a year, and I think that might be pushing it. If you don't file a claim right away, you're screwing yourself, and in this case, you might not have a leg to stand on. Live and learn.

Your employer could also contest that you weren't hurt on the job.
Workman's comp is something that is protected from retribution and retaliation unless you were acting irresponsibly in which case claims may be denied. I think that you missed your window. |
Well, that is close to what I was thinking. I was young and dumb. Trying to support a family at the age of eighteen. The pay was too good to give up at the time... and it really did feel like they were saying I'd be fired if I didn't file on my own insurance (my wife had coverage on me at the time where she worked).

That alone would have been illegal.....
See what the lawyer says, but I wouldn't hold my breath. |
