Need legal advice involving contempt of court
So I got married, cosigned on a car loan. The divorce decree says she takes the car and all related debt. Obviously that does not get me out of being a cosigner, I still have the related responsibility. She was 75 days late and was hurting my credit so I paid up. But my lawyer told me if she does not pay, I can make her pay me back. Contempt of court. So I know if I go to my lawyer he will charge me alot for me to get my $1000 back from her. So I want to do it myself. How do I do this?
I am in the Army. Tried talking to legal but they wont help me. They just told me to go talk to my lawyer. Should I try bugging them again for help? Last edited by MaxPowers; 04-09-2008 at 11:36 AM.. Reason: changed title |

military lawyers are not going to help you in a divorce/debt issue.
the way I see it, you have two options. 1) you can just let this one go and then use the divorce decree to have your name removed from the loan as cosigner, or 2) have your lawyer go after her for the 1,000 plus attorney fees. I am not a lawyer, but those are your two best options. you can try to take her to small claims court, but the time off work might not be worth it.
