EZ pass
anyone have an sucess doing an ez pass dispute
the information they provide to you isnt enough to understand where i was at and they send it to you about 3 months after the fact...... i pay all my tolls and know i havent gone thru an ezpass lane so there is no way in hell im going to pay the administration fee.... |
What are the exact laws in your area? By me, you get like five violations before they send you a ticket. Did you get a photo or anything for proof with the ticket?
|
its not a ticket perse....by me ezpass is a private company....and they act as a collection agency...
they send you a picture of ur vehicle driving away.... but like i said it doesnt give a understandable description of where u were at its in some type of code and they send it to you 3 months after the fact....so i cant even remeber where i was coming or going..... my plan is if they make me pay im going to just take the plates off my truck until i get my 25 bucks worth of toll road travel.... |
Here, you get a picture of your plate going through the toll lane, literally within a few days of doing it, and the violation is $100 fine. Ask for proof and specify you're not paying until they provide you with it.

what's the dispute? i've never had a problem with EZ-PASS...

hard to believe.... ez pass went under an overhaul to work the bugs out recently because of all the false enforcement actions that they had sent out.... my dispute is that i paid...... and i think that this is BS - because its a private company saying they are going to take civil action against me if i dont pay a 25 dollar admininstration fee..... i would be better off if it was an actual traffic ticket because in the united states its still the government that has to provide proof beyond a reasonable doubt....and even in traffic ticket issues the burden of proof is still on the govt. and i dont understand how a picture of my truck is proof that i didnt pay a toll.....machines and computer software isnt perfect |
IIRC, civil proceedings don't offer the same proceedings as criminal courts, namely, innocent until proven guilty. If it's anything like our system down here, the onus is on you to provide proof that you paid.
|
civil courts in my neck of the woods is still that the person or company taking the action needs to make the case...... but its done on Poponderence of evidence...not beyond reasonable doubt..
so basically a judge or juror would have to think 51% that i didnt pay the toll instead of 97% that i didnt pay the toll..... but a picture doesnt prove anything all it proves is that my truck was there..... im thinking of taking a picture of a token and sending it to them.....and my question would be if they were to take someone to court over 25 bucks how much do they lose by doing that....... |
I was able to resolve a dispute w/ EZ-Pass where they charged me for blowing through a toll despite the fact that I had a current acct with money in it. I called some ridiculous number, talked to some ridiculous person, and had the ridiculous fine revoked.
But it was such a monster hassle I might consider sucking up the fee next time, that phone escapade cost me an afternoon of my life. |
they've got attorneys on retainer whose sole job is to handle these kinds of things.
you'll have to pay the court costs, as the losing party. this is one of the worst aspects of turning our traffic violations over to private companies (runnint w/o plates is a hefty, hefty fine...hopefully you don't compound your problems in your understandable anger) best of luck to yah, but I think you don't have much you can do...certainly not without a hassle not worth $25. |
Well heres the deal....like i said the photo they send is very fuzy....so i was looking at it last night and i noticed that the tailgate on the truck in the picture didnt match mine.....i have a ford ranger and it looks like the truck in the picture is a nissan frontier....
so i called up ez pass customer service and after being on hold for 20 mins they guy said the plate was bla bla bla.....im like thats my plate but thats not my truck....and i asked him if he had a better image on file....he did so he pulled it up and saw that it wasnt a ford ranger.....and saw that the image was unclear as to the plate number....he said the last two digits were unreadable to him..... so he dismissed the violation notice from me..... so yes there are bugs in the system....... |
