Why these laws haven't changed is beyond me. I don't think this has been posted yet.

The Colombian immigrant bought the winning ticket at a store near the midtown Manhattan parking lot where he worked double shifts as an attendant, earning about $28,000 a year.
Depending on what kind of relationship they had I'm not sure if she deserves a single cent. If he treated her badly and was a fuck up for the 17 years they were married then yeah. It seems more like the poor guy was doing everything he could to get by and make her happy though and she just fucked him over. Poor guy worked double shifts to pay the bills and now he finally gets some luck thrown his way and she wants a portion of it.

It actually might not work in his favor because then it doesn't look like she is just divorcing him for his money. They were obviously having marital problems and they would have gotten a divorce anyways, so the money had nothing to do with it (or so they will say)

He'll miss half of the 44 or so mil after tax. They are still married although separated. Say the poor bastard died (assuming he had life insurance) the wife would still get the payout even in they were seperated. Anna Nicole won this battle because ... eeeerr...they were married. Yeah they weren't seperated but in the eyes of the law it's the same. Still married ='s what's yours is mine and what's mine is mine for the wife in this case.

Not completely backwards, just the words. If it were completely backwards it would be easier to understand.

Anyway, since she had nothing to do with him earning the money she shouldn't get any of it. Its not like she supported him in his career and he earned it over a few years, its quite obvious why she broke it off when she did. Any judge should be able to see through this. If i were him i would try to find a way to postpone payment in any form until he can get a divorce pushed through. Maybe go and get a quicky divorce someplace.

ppl like that annoy me.. she has been with him for a while and now she sees a way out so she takes it.. but what stopped her from leaving before.. man that just gets me annoyed.. if u dont feel like being with some one then you just need to leave.. dont suffer or stay with someone cuz.. just for the hell of it.. .. aaawww.!!!!

This situaiton may be more complex than the simplistic responses that are coming out. It is quite posible that she deserves nothing, but I don't know that for sure, and I sure as hell can't make a judgement of her at this point. It is also possible that she was a saint and he was the prick who just happened to get very, very, very lucky one day. Again, I don't know.

However, legally, even with a prenup, the laws surrounding winfalls are different then those governing income or pre-existing omnetary holdings and, as such, she may LEGALLY have a fair claim to a chink of that money.

Besides, if it's $88 million, can he (or anyone else in this thread) actually say that thowing a couple million dollars her way to keep her happy (and AWAY) is such a hardship. Man, greed is sick, sick, sick master!

Vox_rox is correct. You can't judge the character of these people based on this one newspaper article. They have seventeen years of history together. Sure, it's fun to speculate that she is the evil one. But you really can't assume anything.

IMHO though it shouldn't matter which one of them was the evil bitch/bastard....they were separated at the time of the win, he used his last few cents to buy the ticket, and won. She's already gone.

I know the law doesn't care about that in many areas, but its what it SHOULD be.
