Legal Advice

I had an interview tonight with a Banking company and it turns out that they were nowhere near interested in hiring me. What happened was that somehow they obtained a copy of my resume and called me up. "We're interested in setting up an interview to hire you for a position" So, I went to the interview tonight and the whole time, they didn't even ask me about my resume, references, my life, or anything that you would expect to be questioned at a job interview. What actually happened was that they were just giving me a lecture on how to get credit, loan, saving money, etc etc. Basically the person who was interviewing me was a human spam mail.

It pissed the fuck out of me that the company found my resume and use it to try to get me to become their latest customer. Has anyone been involved in this kind of thing? I'm looking to consult a lawyer but am I overreacting?

This is what I found in the "Personal Information Protection and Electronic Document Act"

Is your resume posted in a public database?

Tell us the name of the company and we can write them emails to express our disgust with the current policy of jerking vulnerable individuals around.

Providing it wasn't a mis-understanding, that is pretty shitty of them, and I think you are very justified in both being upset and also seeking legal action.

Just the fact that resumes contain a lot of personal information and your's was used not to get a job but to fuel an advertiser/promoter is disheartening.

Is there a Better Business Bureau in Canada? You could report them for poor business handling.

Actually there is, that's a good point...

EDIT: I just visited BBB's website, they don't handle compliants like I've described. Basically they don't handle anything that breaks federal law.

Well that completely sucks.

I doubt you have any legal recourse, but Canada may be different than the US.

Call the guy up who interview you and said you had a question about something he and could you sent up a appointment with him. Then go and waste his time. Just asked dumb question make him repeat this stuff, and if have couple of good friends have them do the same.

You have noooooooooooooo idea. I got this screenname from somewhere... Feelgood, the BBB will handle questionable business actions. If they brought you in under a false pretense, then they could well be misrepresenting other facts. Talk to a BBB representative about it and see if there is anything that they can do for *you*. BBB exists to serve the customer-base of these companies, and since they brought you there to sell you something, you were a de-facto customer. Give it a shot and give me a name. I'll make these guys sing for you.

PS: I just remembered the two $400 travel vouchers I got off of Delta because one of their representatives in Atlanta told me to "fuck off" for no good reason.

Call a Lawyer on it ask him for advice. You can find tons of lawyers in the phone book. Lots of them have a free consultation and many of them if they are free can answer questions over the phone. I have done it many times because I knew they couldnt threaten me with anything that they were telling me but just needed that EDGE to say look I talked to a lawyer now I have the right to tell you where to go and how to get there.
Besides talking to a Lawyer he can point you in the right direction on who to speak to. Another thing you might want to try is call the head office of the company that he/she is from. Tell them who the person was and what he did they might also beable to help you out and maybe even give the guy a warning.

Lawyers won't do anything if there isn't any $$$ behind it. He lost nothing, no property, no funds, just time.

and if his resume is posted on someplace like Monster.com or some other public database, then it's public. It's just a shady business practice.

I doubt it was illegal although it is highly unethical. I would call the banks ombusdman or public relations department and file a complaint. A lot of times the marketing department of a large corporation will do things that the rest of the corporation finds unsavory. If you let them know they may change it from within and even send you an apology.

It may have been public but it was for the purpose of corporations finding people to hire, not finding new customers...

I filed a compliant with the BBB. I think that's all I'm gonna do, no biggie, just the fact that I wasted my time and pissed me off...
