The Mother wants to be compensated because of a railing that (in her opinion) was not bright enough to see.

I'd be a fucking trillionare by now if I sued each time I hurt myself as a kid.
Or what about that girl in the fith grade that played show me yours and I'll show you mine.

STAMFORD, Conn. - A 2-year-old model and actor who cut his head at a playground is seeking unspecified lost wages and other compensation from the city.
Konrad Mader of Greenwich was running toward a treehouse at a playground Nov. 4 when he crashed into a railing, according to a claim filed last week by his mother and reported Friday by The Advocate of Stamford. The blond toddler received several stitches.
Deena Mader, the boy's mother, did not specify how much she is seeking on behalf of her son.
In a letter to officials, she demanded compensation for medical bills, pain and suffering and a "lost wage amount due to his inability to audition or take modeling or commercial jobs while his head heals."
Mader blamed the boy's injury on a green railing, which she said blends in with the landscaping. Mader said the railing should be painted a brighter color.
"This accident was preventable had the railings and safety measures been correct at this park, " Mader wrote in her claim.
Tom Cassone, the city's director of legal affairs, said his office is investigating the claim.
Joe Falzone, a facilities manager in charge of maintaining city parks, said he is not aware of defects in the playground and there are no plans to make changes.

Aren't there laws against underage children working?

Everyone just wants a quick buck. If I'd sued for every time I'd cracked my skull open or broken a bone then my butler would be typing this for me.

At this rate, people will start suing for injuries and lost wages that happened in THEIR childhood...

Hey, I remember this one kid in junior high who gave me a concussion... I should sue his ass for lost wages due to lost IQ points due to potential brain damage from that injury, then sue the teachers for not keeping an eye for my safety 24/7, sue the school for hiring incompetent people and insufficient security personnel, sue the city for letting such a school exist, sue the state just because the city is inside of it, then sue the United States of America for letting people waste our tax money on such stupid and frivolous lawsuits.

Seriously now, that kind of story just makes me want to design a playground to be as hazardous as possible, with viscious sharp-edged railings positioned just right to decapitate little children and their nasty, litigious parents, and avoid any further messy lawsuits. It shall be called the Playground of Death, and have lots of skull-and-bones signs everywhere around the carnage. Hell, even with the growing pile of baby corpses rotting in plain sight, some people will STILL get injured here...

What does it take to electroshock people into being responsible for their own children and safety? What sort of heinous experiments must I conduct on the legal staff, to make them automatically throw out any cases such as this one, and laugh maniacally (and involuntarily, if possible)?

There's shitload of people that's willing to sue for just about anything just as long it gets them money. There's even some people that's willing to go as far as getting themselves "hurt" and then sue the person that "hurted" them. Frankly, I'd rather kill them then let them have my money if they tried that on me...

Hmm I used to think the same way, but an interesting thought popped into my head, and I'm not quite sure anymore that its society in general thats to blame.

Think about this: TFP (and other chat forums in general) probably contains quite a diverse population of Americans, yet I've never once seen anyone agree with such frivolous litigation, and always found such stories ridiculed and put in their place. This suggests to me that most internet-savvy Americans who participate on message boards despise frivolous lawsuits and the people who make them. People who do not have access to the net probably do not have access to a lawyer for such frivolous purposes either, and this whole this does not apply.

So now I think I'm beginning to understand that its in fact just a vocal minority, people who have their lawyer on speed-dial, who actively seek out ways to make money off other peoples' suffering. It takes a special kind of personality to sue frivolously, don't you think?

people and their desire for money... pisses me off really. i don't think the city had any intention of actually harming the kid. it's the kid's fault (and probaby the mother's too) for hitting his head on the railing. the mother should have been on watch and the kid should be looking on where he's going (even thoug he's 2, but still...). hopefully the judge ain't too sympathetic...

Hey this one time after i drank way too much i stepped outside and tripped down the the curb, and know i wanna sue because the ground was not at a safe level, how dare they put the road below the curb. Do I have a case.......

I took several courses in college on business law. We heard some of the most outrageous cases and settlements that were won by the lamest circumstances. A burgular of a warehouse falls onto the floor from the skylight, breaks his leg and sues the company. $300,000 settlement. I was literally appalled at some of the cases we read. People know there is a loophole in our legal environment and they will do what it takes to benefit from it.

Don't forget the bloodsucking lawyers promoting these lawsuits as well.

Simply ridiculous. If he would have been successful in robbing the place, he would have been in jail for awhile. Since he was unsuccessful and broke his leg, he gets $300,000...whoa. The jury must have been crooks themselves and sympathized with the guy.

What other appalling cases did ya hear?

Kid hits head and sues. Another case of idiocy from the rich, stuck-up asshole town that society has decided to call Greenwich. I avoid the place whenever possible. Sure, there are some nice people from some parts of town, but the majority of them are Just like my home town. Rich, stuck-up assholes who will do anything for more money.

So why bother burgling the place? Probably only get $1000 - $2000 worth of stuff - just kick a hole in the skylight, jump to the floor and take them for all they are worth!

We might as well just stop going out and doing anything from now. The fear of being sued will prevent us from being involved in anything soon.
Imagine being sued by the drowning guy you pulled from the surf and applied CPR to - he now has recurring gay dreams, some bloke keeps kissing him in his sleep.
Or the fear of getting into an elevator (elephobia? or is that the fear of elephants? Could start a new thread on that one). You fart and the other person sues you!
