Do i have to pay for something i didn't agree to buy?
 
hey. so a couple of days ago some company call me telling me i was being 1 of the 25 people to qualified to get a discount on some program to learn english. I told them that i didnt want nothing. so somehow they keep talking and they got me to tell them 3 of my friends phone number and there name and also my street address. they also told me that the government was gonna pay part of the price of that program. i told them i didn't have the money to pay the program.. the cost of the program i think it is of $2,000 but since the "goverment" was gonna pay part of the money i just had to pay $600 ($100 every month). So i called the other day to tell them again that i didn't want that program that i didn't need it. so yesterday they call me telling me that i was approve and the paper was send automatically and that i had to pay $199 by tomorrow! and if i don't pay the $199 they are going to start a legally process against me and my 3 friends. what can i do? please some help me? thanksss

Call the attorney general's office for your state. Get off the internet and do it now.

This. Most states have an office of consumer protection, or some division thereof. Get in touch with them.

Until they can produce something proving you agreed to pay for this - which doesn't exists - you not only don't have to pay, but you get to keep whatever product they send you.

According to the Federal Trade Commission:

Whether or not the Rule is involved, in any approval or other sale you must obtain the customer's prior express agreement to receive the merchandise. Otherwise the merchandise may be treated as unordered merchandise. It is unlawful to:

1. Send any merchandise by any means without the express request of the recipient (unless the merchandise is clearly identified as a gift, free sample, or the like); or,

2. Try to obtain payment for or the return of the unordered merchandise.

Merchants who ship unordered merchandise with knowledge that it is unlawful to do so can be subject to civil penalties of up to $11,000 per violation. Moreover, customers who receive unordered merchandise are legally entitled to treat the merchandise as a gift. Using the U.S. mails to ship unordered merchandise also violates the Postal laws.

How did they get you to disclose that information? Did they reach through the phone and twist your arm??

Why talk to these kinds of people? Why talk to phone solicitors at all?? Why be a willing victim?? Sheeeeesh!

This is correct and also why I have two expensive coffee pots.

MSD, youve been talking about these two pots for years but i dont believe ive seen them yet....:D

Thanks guys this is going to help me alot. they call me today saying that i have to send the $199 to receive the program and they said that they cannot cancel it because it was approve automatically by the government.

Tell them that you're talking to your lawyer and the attorney generals office and you wont be making any payment until you get advice from the AG office.

Government departments that ive dealt with takes weeks if not months to get their shit together. I doubt that they'd get this rolling in 2-3 days. This has scam written all over it.

Don't send them any money. Ask them to prove that you agreed to accept their offer. They can't, therefore there's no contract. That means you get to keep whatever it is you're going to send them if you want.
