Confused on the Meredith Emerson case
I dont know how many people know about this case, I will post the story...but here is a readers digest version of it
Meredith went missing on Blood Mtn in Union County Ga Jan 1 Man of interest was taken into custody, he made a deal with Union Co DA to show were the body was in exchange for no death penalty (unless he is linked to 2 other cases in Fl and NC) Deal was given, man took authorities to body in Dawson Co Ga Evidence has actully been found in 5 or 6 counties now, but kidnapping took place in Union, body found in Dawson Now the Dawson Co DA is saying he was never in on the "no dealth penalty" deal my question is....... Initiation of the crime in one county and that DA promises one thing, end result of the crime in another county...I dont know if anyone is sure which of the 5-6 counties involved the actual death occured in....does the "promise" of one county DA hold water anywhere else? Also, does the disgreement of who/what/when dealing with the different counties and DA's affect "future" deals. What is the significance of the Dawson Co. Reading more brings to mind another question....IF he is linked to the case in FL and the case in NC and he got the death penalty in those cases as well...which state executes him?

I think these agreements probably require all DAs in the crime areas to give immunity. We have a similar case regarding immunity agreements here in southern Ohio.
The foster parents of Marcus Fiesel (Liz and David Carroll)) along with their live in girlfriend (Amy Baker) left him bound in a closet while they went to a family reunion for a few days. When they returned he was dead. They claimed the boy was lost in a local park meanwhile Amy and David took the body to the country and burned it and on the way home dumped the remains in the Ohio River. After weeks of the community searching for the boy Baker agreed to testify against the Carroll's in exchange for immunity and they were both convicted of murder. The local DA got immunity agreements with the DAs in Ohio but apparently did not consider that the Ohio River where the remains were dumped is technically part of Kentucky. Many people were angry that Baker got charged with nothing for her part in the crime. The DA from Maysville located on the Kentucky side of the river charged Baker and said Kentucky was not included on the immunity agreement. thats flstf.....what about this....the US DA was in on the deal as well (because she was kidnapped on Federal land)....(remember they said if he's connected to FL and NC the deal was off) so does, looking at GA only would that trump anything any georgia county DA said (or didnt say)

We have a similar sort of thing unfolding here. The DA in another county has no professional obligation to honor an immunity deal given by another DA. It is up to the DA and their county to decide how best to pursue their case.
Four or five years ago now a young woman went missing from an apartment complex south of campus. It was shocking, because we live in a very safe town. Two years ago they finally indicted a guy who lives in New Mexico for the murder of this girl. They still haven't found her body. Meanwhile, the guy they indicted was brought up on charges in New Mexico for the sexual assault of a UNM student. He was finally convicted on those charges before Christmas. Our DA went and spent a week down in New Mexico during the conviction and sentencing so that he could make arrangements for speedy extradition to Oregon. Now, we have to wait until the guy is transported to our county. The trial is expected to begin sometime this spring. Oregon rarely executes people (only 2 since 1976!), but they will use the possible death sentence as a bargaining chip to find Brooke's body, as was done in the Georgia case. That said, it is possible that Oregon could end up executing someone, but highly unlikely. We just don't do that here. As for him receiving the death penalty in multiple states...I would suppose that would have to be worked out between the states. Executions can be pricey. As for the moratorium on executions, Justice Scalia said in an opinion that just because the Supreme Court has decided to hear the case of Baze v. Rees (which questions the constitutionality of lethal injection, arguing that it is cruel and unusual punishment), states do not have an obligation to stop executing those on Death Row. However, many states have issued moratoria on executions, as they do not want to execute someone with a method that may or may not be constitutional. It is important to note that not all states use lethal injection (Washington and New Hampshire, for instance, still offer hanging as an option). So I think it's one of those things where we all just have to wait and see.
