Sexual Assault?
So two boys in a town about 45 minutes from where I live have been charged with misdemeanor sexual assault (downgraded from a felony) after slapping some girls on their bottoms while in the hallway at their local middle school.

One of the quotes that caught my eye here was this: Quote:
To me, pinning this up as a sexual assault case trivializes actual sexual assault. I was sexually assaulted by a handicapped classmate when I was 13 (to be brief, he attacked my friend and I at the bus stop, told us he was going to rape us, and nearly ripped my shirt off trying to get at my breasts). In my opinion, being slapped on the bottom by a classmate is nothing--certainly not traumatizing or life-changing or horrifying. Being attacked by a 300-lb developmentally disabled person is. If these girls had truly been victimized by the actions of the boys, they have the responsibility to speak up to the police and the court. But it doesn't sound as if that is the case. If swatting someone on the bottom is sexual assault...I'm in trouble. I swatted my share of bottoms in middle and high school...and continue to do so. In fact, when I was a senior in high school many of the cast members of the musical that spring used butt swats as a greeting, much as these kids claim to be doing. If the school has an issue with it, let the school deal with it, but criminal charges are going overboard. We don't need to let a silly adolescent prank ruin these boys' lives--plus, McMinnville has a youth meth problem they should be spending their money on, not this.

I think that the key to the whole thing is this:
Quote:
For the record, I'm guilty of this too, as are a whole lot of male athletes. When I was racing and would pass a teammate, I'd usually pat them on the butt as a way of nonverbally communicating "pick up the pace and stick with me". Criminalizing this is moronic. Glad they've solved all the other problems at that school.

If nobody objected, I'd have to say assault is in the behind of the slappee...that's a really inelegant analogy.
Anyhow, perception is 90% of the issue. Because nobody objects, it's hard to call it assault. Sort of like punching someone in the arm when you pass in the hall. It's certainly inappropriate - A guy a year ahead of me in school was a notorious ass-slapper and -grabber, and it made walking down the hall a horrible experience, trying to avoid his busy hands. It was disturbing and distracting. You shouldn't have to worry about that kind of shit. On the other hand, criminalizing this isn't going to do anything but incarcerate and stigmatize teenagers who would do better with a good talking-to.

Sounds to me as if a lot of people have forgotten what it was like to be a middle school student. I slapped my fair share of female asses. But, that was back in the 70's...before 0 tolerance policies, and the abdication of common sense.

Ugh, it's all that political correctness gone amok. Boys will be boys, just let them be. They're not hurting anyone. I'm so glad I'm not a kid anymore in this day and age with all the expelling of 5-year olds for innocent kisses on their class mates. Next thing you know we'll go the way of the Europeans, like the Swedes who want to ban men from peeing standing up.

I think that this is ridiculous. It's a total abdication of common sense to charge sexual assault in this case, especially if the victims don't think it's sex assault. I also think that the sex offender laws are by far overused, given that they're not limited to rapists and pedos. (probably because it makes the sex offender problem look like it's more rampant than it acutally is, and gives politicians something to rail against when election time rolls around)

This isn't sexual assault. Whatever happened to suspending kids, do they just automatically call the cops now? In the same vain, whatever happened to actual handshakes, is that too passe for kids? I think a better form of interaction would be nodding. I'll admit it's not quite as personal as the actual touch. However, if you can get the timing right you can pretty much nod any greeting you wish. From things like, "Hello! Nice day, isn't it?" to "Yes, I'll buy you a drink and probably never see you again", they're all covered in nodding.

What's next, they're going to arrest all the High School males that play sports for slapping their asses on their way on and off the field?
Who's overprotective self-righteous PC-overdrive parents got their kids to testify against these boys? Was there ever a point that any of these "victims" told the other people that it made them uncomfortable? Or how about a good old-fashioned "Quit touching my butt, dammit!!"? We're not going to have to worry about the bloody terrorists, ridiculous garbage like this is going to destroy our society long before they do.
