I think this is really sad actually. I believe that the Humane Society is correct in upholding their laws, although I think that 5 days is a little short of a span before giving it up for adoption.
I also think the woman who is keeping the dog is a selfish bitch. Being from San Jose, I know the Los Gatos area very well and know there are a lot of over priveledged, under deserving people who live there. Of course it is just a stereotype, but one that she seems to be falling into. Why not just get a new puppy for her daughter? When the dog was originally found, I don't think the daughter even knew what the dog looked like, unless she went there to pick it out....I dunno, just give the dog back! Sheesh!
