Here's a REAL grey area, though: what if that person changes their mind during the process and
doesn't say so? For whatever reason they feel too intimidated or pressured to say they're having second thoughts? Is THAT rape?

No, I expect that IS the issue. A person under the influcence is not legally
capable of giving consent. Sex with an inebriated partner is by definition non-consensual under the law.
This movie sounds pretty exploitative too, to come back to the topic at hand. It plays right into the hands of the State Attorney releasing the film to the public. There's very little reason anybody should ever want to watch that video apart from the tittiliation value of it. Making it public is just sleazy. "The people can make up their own minds" indeed--that guy should be disbarred.
