In my state, it's called "failure to control vehicle".  Heck, I had a freind get one because some idiot pulled a U-turn in front of him.  He wasn't drunk, just in the wrong place at the wrong time and ended up totaling his car all because of a "road hazard" he had no time to avoid.
 
Unfortunately, I don't think the courts think that way when it comes to civil suits.
