So, the guy formatted his computer and lots of picture files of their kids. He then uses a data recovery program to restore the picture files, and around the same time the old porn pictures reappear and his wife is pissed about them being there. That sum it up?
He has a good alibi, really. If he used the data recovery program to recover the pictures of the kids, he could have had it recover all files of that type (*.jpg, etc). And of course in doing so, the time-stamp would be updated to the date of recovery.
Even though his alibi totally possible, it sounds like his wife just thinks he's lying. She seems a bit overly pissed about the pics really... perhaps they're actually pictures of her or one of his ex's that she told him to get rid of (in which case she would be justified, imo). There's no way of knowing, but I wouldnt be surprised if he came across them when restoring the other pictures and decided to restore them as well, thinking that she had forgotten and wouldnt find them.
