THC is detectable long after the effects are gone. Just because someone tests positive for THC doesn't mean they are stoned at the time. All it means is that they've had some pot in the last week or so. If that's bad enough to warrant firing, I guess that's your right, but it's more anti-drug paranoia than an actual concern IMO.
I'd be more concerned if an employee came to work hungover over an employee that smoked a joint to previous evening. I've hired several dozen employees over the last 18 years and never had a problem with guys that smoke pot on occasion, but I have had major issues with workers and booze.
In fact, Flyman (a pot smoker) was one of the best employees I ever had.
