OMFG Subway employee attacks me
 
Okay so here's the scoop. I go to Subway about once a week. I always get the same sandwich. Most of the guys there recognize me and we usually share a couple jokes. I am a nice guy, and I am always as pleasant as possible to these people because I know that kind of job sucks, and shitty customers make it worse. Fucking I even toss them a tip if I end up with a dollar change or something.

The last few times I've been there, this one guy has ignored me completely and waited for one of the other (busy) employees to get to me. When they're serving me, he gives me a fucking death stare. Now, I'm not a paranoid guy, so I just ignored it as him probably having a bad day and needing a break or something-- whatever.

Tonight I go there and I buy my sandwich as usual, and I notice him standing in the back giving me the staredown. I also notice he's not even in uniform. Whatever, I think to myself, he probably just got off his shift and was hanging out. So as I'm paying for my sandwich, I notice this big muscle man hovering near me for no good purpose. I don't make a big deal about it, but as I'm heading for the door, I see the guy that hates me standing outside, waiting for me, staring right fucking at me.

I go outside, and he immediatly jumps down my throat claiming that every time I come there, I insult his brother who works there (I didn't realize these two guys were brothers, but they had the same dreadlock hair style so I guess it goes to figure). Now I'm completely taken off guard because 1) I go OUT OF MY WAY to be nice to these people and 2) He doesn't even approach me civilly, he comes out guns blazing and acting like he wants to kick my ass.

At this point, I notice Muscles is hovering around right by the door with his arms crossed giving me the stare-down. So I realize this is the guy's insurance in case I were to physically explode (which I wouldn't, I'm not so petty). But I get so fucking pissed off, I end up shouting and cussing back at him telling him how I never gave anyone a hard time, and demanding examples. He pisses around and just keeps repeating "Fuck you man and stay away from my brother, just stop fucking coming here."

So of course I'm thinking, who the fuck does this guy think he is. He is maybe 18-20 years old (I am 21) and he is telling flat out insulting me without any proof and trying his best to threaten and scare me, which is laughable at best because we're standing out there in front of a Subway in a happy rich suburbia shopping strip... This isn't some gangsta back-alley shit. It's just two white guys being obnoxious.

I quickly realize this is not going to go anywhere because he is extremely hot-headed (as am I) and was clearly not open to a reasonable discussion (granted, I turned into an asshole pretty quick, but at least I was asking for some good reasons).

So I left, absolutely pissed to shit that this fucker would accost me like that in public in such a confrontational manner. I was pissed off for hours, and muttering how I was going to go back tomorrow morning and find the manager and do some serious bitching.

I am still pissed off, but now that I have a cooler head, I was trying to see it from his point of view. So I figure for SOME reason he or his brother think I'm an asshole... Fine. Somewhere along the line I guess these guys are insecure or something and built up this horrible image of me in their heads and managed to take anything I do the wrong way. And then I thought, okay, if that's the case, then I guess maybe it is admirable that this guy is sticking up for his brother. But the fact that he waited for me outside and immediatly cusses me out with his bodyguard standing by was such a horrible and immature way to go about it that it just left me seething with anger.

Even if the guy waited out there and pulled me aside and TRIED to have a calm conversation about it, I'm sure we could have worked out whatever the misunderstanding was. But no, he had to be a COMPLETE fuckwad. I'm sure it all has to do with him being immature and probably insecure... whatever.

I am still tempted to find the manager and complain, but I figure I might just be blowing hot air into someone that doesn't care and won't believe my word against their employee's. I feel that the next time I want a fucking sandwich from there, I will go (despite his warnings for me not to come back) and I will order the same thing I always fucking do. If he or his brother is there, I'll try to keep it calm and drop a "sorry for any misunderstanding, please don't be a fuckwad again" apology in the most tactful way possible but also showing that I don't give a flying fuck what this guy thinks.

Anyway, I guess the point of this is that I'm just still really ticked off and I'm mostly just venting on a medium where I know cooler heads prevail (if I tell me friends, they would just get hot-headed knowing someone was so blatantly unprofessional and immature).

I agree totally. The best way to keep others away is to show them whose boss. Hit the gym and take some boxing lessons if you need to, then make sure he doesn't bother you again.

But for a more peaceful solution, just talk to his brother and see what the problem is. His brother could probably resolve the problem a lot quicker and you wouldn't have anything to worry about.

Not sure what I would do at this point. I probably would have ended up brawling in the street with the jerk but I think I've outgrown that now (probably not but one can hope).

Anyway, I'd go to the manager and then I'd stop going there anyway. Who knows how many special sandwiches you've gotten since going there and how many you'll likely get if the guy's fired and the other workers take it out on you.

I agree with the second part of onetime's answer. I'd write a letter of complaint to the manager, cc it to Subway corporate, then stop going there because you can be damn sure that if they haven't already messed with your food, they will now.

As to the people calling for beating the kid up, that's the dumbest move you could possibly make. Those posters are apparantly willing to get you jailed and charged with assault so that you can keep your supposed dignity. Besides, you do not know that the brother actually told this guy to go after you, so kicking HIS ass might be completely unwarranted. Plus, starting fights when you don't HAVE to fight is just stupid. Why risk it? With an attitude like that, this kid isn't ever gonna be anything but a sandwich slinger anyway - I call that punishment enough.

Anyways, don't bother kicking his ass, it woudln't be worth it, and that would leave him pissed and wanting revenge, so no! I would definately file a complaint asap. They probably won't waste any time before they fire his ass. If they realize that they're losing business becuase of his "shovel-up-his-ass" attitude, he'll be gone in no time.

It was kinda freaky to read about at first...you made him sound like he was a stalker or something along those lines. The way that he was always lurking somewhere, staring at you...:eek:

What this cretin is doing, is tantamount to menacing, which, in most counties is a criminal act. I'm pretty sure the store owners don't want a lawsuit on their hands due to this guy's obvious anger issue. Sounds like a powder keg about ready to blow. I would complain...loudly.

Not that tough if they know you're a regular. Just put a special roll or two off to the side, maybe "pretreat" your usual choices, etc.

At the very LEAST, complain to the manager. That is totally unacceptable behavior. According to The Subaway Employee Handbook, page 13, section 3, paragraph 12

"Employees should refrain from threatening to beat the shit our of customers. Telling customers not to come back is frowned upon, as it may impact the ability of Subway Stores to sell sandwiches to the aforementioned customers."

i wouldn't even bother talking to the manager - i'd go striaght to subways headoffice and bitch and complain. that kind of behaviour should not be tolerated, especially if you did nothing to deserve it.

Small problem with this, yea you can file a complaint with the corporate office. All they do is send a letter to the store manager, and most of the time the store manager sends it stright to the trash can. I know from personal experience. You need to go there and personally talk to a manager. It is the only way you will get this issue resolved.

Absolutely agree on all counts. I wouldn't risk having my food screwed with, especially a Subway when there's one on every corner. Complain to corporate and piss on them by going to Quizno's. :D

I didn't even think about this. It could be construed as harrassment since you were leaving the restaurant and he was waiting for you. Not that yo necessarily want him to get in trouble NOW. But if anything else were to happen in the future then you've got something on record. I work for a multi-billion dollar Fortune 500 company here in the US. I head a company group that studies our electric usage patterns. We spend approximately $18 million a year in electricity. Anyway I was trying to get some information on one of our accounts, and I was dealing with a large utility in Texas (that was coincidentally in the middle of a $6 million negotiation with us). I called their customer service number and asked for some basic information on the account so we could get it billed correctly. The customer service representative said she couldn't give me the information since I wasn't the one that set it up. She wouldn't budge even though I was from the company in question. Well that was fine since I understand that all companies have rules, so I asked to speak to her manager. She hangs up on me. I thought it was a mistake, so I called back and got the same woman. She hung up as soon as she heard my voice. I waited till the morning and called the contact for the contract we were negotiating, and I complained. I heard she was severely reprimanded. I would have done the same thing regardless of whether we had a position of power over this company or not. I just don't put up with bs when it comes to business and when I haven't done anything to deserve it. I can only hope that a lesson was learned.

Don't let this go. Next time you go in, hopefully his brother will be there and you can calmly ask him how you insulted him. If by chance you accidentally did something insulting, being the nice guy you are, I'm sure you would be more than happy to apologize. And still, File a Complaint.

And like others have said, file a complaint with Police. They may not be able to do something, but a record of that guy's history with the cops can be good ammunition if he causes you any more trouble.

You should immediately file a complaint. Make the company lawyers and managers know that they have a situation. If they are aware and do not fix the problem, then you have a suit if things progress negatively. State time, date, store location, names, ect.... Do not go back to the store unless Subway management tells you that you can. Don't be put in the bad guy position.

In the future: When someone gets in your face, disarm them by being nice. Use tact to make them feel that they are the real problem. Ask leading questions. Put the monkey on their back. State that you have no idea where they get their opinions from. They are incorrectly making assumptions based on faulty information.

If you MUST get into an altercation make sure it is witnessed by neutral individuals. Make sure they throw the first punch and that you only fight back in an effort to defend yourself.

Then sue all involved. Get the money. Wait a year. Then find him in a neutral location and lay him out if you still feel the need.

BTW, listen for comments about them "spiking" your meals. That is huge grounds for a suit.

No I am not generally sue happy. I do believe it is a tool to keep shit real.

IMO, you should go talk to either brother (preferably the one you supposedly insulted and didn't explode) and ask to talk to him at one of the tables. Find out what he was offended by, because if i found out my actions resulted in so violent a reaction, i'd want to know what I did so i wouldn't be insulting anyone else. Then talk to the agressive brother, IN the restaurant, and tell him something along the lines that there was misunderstanding on both sides, and could start over on a clean slate.

Depends on the company. I filled out a generic complaint form at Fry's Electronics and dropped it in the mail. 48 hours later, they called me up and got the shit straightened right out. Then they sent me a followup letter to make sure I was happy.

Well I am stunned. I sent a detailed complaint via email to the store, and I got a reply from the manager telling me he reviewed it and watched security recordings of the visit and others of when I've been there. He claimed 1) That the guy never yelled at me or used foul language (untrue) and 2) He listed various insults that I apparantly gave the brother which I know for a FACT that I never said-- nor anything that could even be misconstrued as such.

I'm literally floored that the manager would reply to me with bold faced lies, and then go on to claim I was taking advantage of his position by attempting to "fabricate" a complaint out of thin air.

All I can say is I will definitally never go to that Subway again, and probably never another in their entire chain. Heh... I was practically assaulted by one of their employees, and the manager comes back to tell me I'm a liar. Well fuck that.

Thanks everyone here for your advice. If I would have just let it go without contacting someone, I may have still given these assholes some of my business.

Fuck that shit. You should go back and talk to the manager in person. Tell him you know he's lying and ask to review the portions of the tape in question. If he won't, then you should get the name of his district manager (or equivalent) and talk to him personally (not emails, they are way too easy to ignore). Just keep following up the chain of command till you get it resolved.

Don't be tempted. Go. Your word of mouth story could easily cause others to go somewhere else, and the whole god damned chain could go down the drain. Never underestimate the power of bad words. I trust this is not a temptation as you have described. But if it were me, I'd think, "hey, this needs to be done, dammit." Then the other side of me would say, "yeah, and that stupid ass will stop by my house when they know I complained." Whatever. I'm shocked. Apparently you are going to get no satisfaction with the manager if he is pulling this shit. So don't even bother talking face to face with him. You'll get the same run around.

Go to another Subway and talk to a manager there. Explain your situation and ask if they can provide you with some names that you can contact. The other Subway should be more than willing to help. They don't want bad word of mouth spreading to their store.

I'm starting to think my "baseball bat" idea wasn't so crazy after all....eh Mephisto??

In dealing with these situation. I find it best to just ignore them and continue with my business. Save both of us a lot of trouble. The guy probably think I'm a pussy, but it shouldn't matter. Whats really good is that I know in some way, hes a little bit pissed that he didn't get what he wanted. And its gooooood. :D

I agree completely with what Kutulu is saying here.

This story actually makes me rather peeved. Since I doubt you would go through the effort to like on a message board, I'm going to take your word on this one.

These particular subway employees are being fuckwads.

I work at a food place myself, and recently some girl complained that I was being rude to her. Apparently she was fishing for change and I told her not to worry about it as I had already removed tax for her. Evidently my removing tax and telling her to not worry about her damn pennies was being rude.

Yeah, so I just ignored it. I don't even friggin' know who it was to be honest.

Sorry, I was ranting...

um... yeah, you really should go back there and give the manager a piece of your mind. Bring a frickin' tire iron, too. That should get your point across.

My god. I am so appalled by this story and the managers reaction, that I am even tempted to boycott Subway myself.
I know that where I live.... every Subway is always hiring. They cant get people to work there, or stay working there. Perhaps thats part of the reason the ass hokd manager took the approach he did. He doesnt want to have to fire one of the few people who is willing to work there.

That may very well be true. Employee turnover in Fast Food places is VERY high.

But you need to call the police the very MINUTE that you have a free second because those tapes are usually recycled once a month. Go now. Do not let them walk on you like this.

Dude, all I can say is Fuck Subway and McDonalds and all of the big chain food places. Small businesses are usually managed by the owner who cares enough about their business to NOT fuck it up by hiring goons.

I would make sure you filed a police report on it and say the managet threated you also, then go in there and get a sandwich and poison it. When they find you dead, the police should put 2 and 2 together and those bastards will rot in jail!

On a serious note subways are franchises so most of them are individually owned. I don't now what effect this would have on going higher up in the corporate ladder. I also believe that the e-mail could of been intercepted by a shift manager or another person. Guess you just need to decide how much closure you want on this matter as you should of already decided to never go back to that location.

meepa, you can't let them get away with this. If you let the matter drop, it's only going to encourage the employee/his brother/the manager the next time something like this happens, and some other innocent is going to get screwed. Even if you feel like there's no reason why you should pursue the matter, maybe you could do it for the rest of us.

I would talk to the brother, ask him what was said between the two brothers and ask if he has ever said anything to him to make him feel like he was insulting him. If he says yes tell him your sorry and mean it and if the brother confronts you again I'd tell him to screw off and bring his brother next time so he can speak for himself. Or hit him in the face with a phone, John Cusack style.

The manager might be sticking up for his worker because maybe the guy works a ton and it would be hard to replace him. That could be a reason too. Try to think about the manager's position (this might be the case, might not):
I have a worker who works a ton (or average) and replacing would be rather difficult, so I hear one complaint from a customer and I am supposed to have to put forth more effort and work just because of this one incident.

Take matters into your own house, make him [asshole, not manager] and fuck him up, either physically or mess with his car, etc. Nothing illegal though....................
