HIV-positive man arrested over unprotected sex

ST. PETERS, Mo. - An HIV-positive man was arrested on a felony charge of having unprotected sex with his girlfriend because authorities said he knew he was infected.

The woman, who was not identified, is awaiting test results to find out whether she has the virus, which causes AIDS.

Authorities said Aaron Sindelar, 28, began having unprotected sex with her shortly after he was released from prison in January for a second-degree burglary conviction. He knew he had HIV, authorities said.

Thursday's charge of recklessly risking another with HIV infection carries a possible sentence of five to 15 years, sheriff's department spokesman Gerry Pollard said.

Sindelar was being held in state custody Friday on an unrelated probation violation, officials said. If released, he will be jailed on a $125,000 bond. Police did not know whether he had an attorney.

Missouri is one of 30 states that make it a crime to knowingly expose others to HIV, the virus that causes AIDS.

Every state should have this law. I'm sorry people get infected, but once they know they are they need to be responsible people and not have sex with people who don't have the disease. The possible prison sentence seems pretty reasonable to me.

Fine. But also charge the person who had the sex with "self-endangerment" or some other self-injury law. It takes two to tango, and with consent comes responsiblity. Make the person who took the chance as responsible for reckless self-endangerment as the infector who committed a sin of omission.

Only problem with this is in the case of a monogomous couple that has been together for a while. It's common for a couple in that situation to stop using condoms and only use other forms of birth control. Then if one of them is cheating and is diagnosed - they are then the person responsible. They will have to be careful to only charge those who were truely knowingly irresponsible.

Did you read the whole article? Everyone except for libya, a place not known for its good medical care or good legal justice system is suggesting the Bulgarians had nothing to do with it. Or are you simply suggesting that Libya's law enforcement is a little more strict?

honestly, no. i was being a 'headline whore' and skipped the rest of the article, because i was searching for a local story about a guy on trial right now in Seattle for knowingly infecting DOZENS of women with HIV. but my search turned up nothing. my bad.

Would it be any different if he used a condom but didn't reveal his HIV status? What if she tested positive after condom protected sex? These kind of laws will just keep high risk people from getting tested. Because if you don't know you have HIV then you can't be charged.

In the case of a long term relationship I can see some culpability on the infector, since a LTR is a relationship based on implicit and explicit trust of your partner. However in this situation the guy is a convict-someone you might not wanna trust in the first place. I don't know him or her, but chances are she's a moron who got herself a con bf and jumped into this with a blindfold on. The same exact thing can be said for casual sex without protection.


Another pitchfork point: If the rubber breaks and she gets HIV or she gets it from him thru a manufacturing defect in the condom, will he be charged with manslaughter like in a car accident? can he be culpable for accidental infection? and if a man doesn't disclose his status but accidentally infects his partner in this manner is he legally culpable? I mean if you provide seatbelts while giving someone a lift and that seatbelt breaks in an accident that wasn't your fault and they die, are you at fault? Can you predict the condom will fail in a given sex act?


the biggest problem with someone who has these diseases is they dont' stop being human...they still want to lie next to someone and be intimate or just get laid. They know for a fact full disclosure will ensure they will be sexless for the rest of their lives. So they have a dilemna; Do I forgo all sexual activity or just wear protection and hope nothing goes wrong? Remember not all ppl are as noble or strong as you might be...some may not be able to resist their sexual urges and take a chance.
