SCOTUS - US Supreme Court (and other court stuff)

    This Thursday.

    What will happen? I see either of the following scenarios as highly likely.

    Take forever to review the case, then table it until after the election.

    Find a way to apply immunity to NPD Trump but not to Biden. Perhaps say immunity does exist, but it isn't blanket or automatic, it has to be determined on a case by case basis.

    Frankly, this is the dice rolling..
    It could go either way.
    A crapshoot.
    Not because it should go one way...but because the majority of the court is biased. (and some have some literal connections to one side)

    As the link says, most justices think the prez should have "some immunity".
    I think the closest prez that got reviewed for abuse of power, was Nixon. (and he was pardoned before anything could happen)
    And I haven't heard his name come up yet.

    The advocate for the government side has some good cred, and is one of the better ones to make the arguments.
    But from the line of questioning, a few justices seem to have made up their minds. (either way)

    Thomas is notorious for not asking anything, but he'll definitely vote to Chump (he's almost 100% reliable)
    And Alito will more than likely side that way to, he's fairly reliable for Chump.
    The 3 non-conservatives will likely vote for allowing a court case. (Sotomayor, Kagan and Brown)

    So we've got Roberts and Coney-Barrett are unknowns, so far.
    Kavanaugh tends to go with Roberts. (so that could go either way, but he doesn't like the vagueness...however, much of the Constitution is fairly open and vague...but there's no precedent here to push either way)
    and while Gorsuch is usually fairly conservative...some of the previous statements when he was an appellate judge have been leaning towards rule of law and not giving full immunity.

    So, we got
    2 for full immunity
    1 for partial immunity (Kavanaugh will allow it, IMHO...but wants some limits put in.)
    3 for not
    3 are up in the air.

    I think they'll go for partial immunity...saying the prez doesn't have carte blanche, but in many cases the prez does have more leeway.
    Question is...what will they allow it for and what won't they.
    They may split the difference, saying that the documents, he can do what he wants...prez prerogative.
    But for the election interference, they will say that wasn't an emergency or security risk...and allow a case on that.

    What do y'all think???

    come up with some kind of partial immunity,
    kick it back to the lower courts,
    and then breathe a sigh of relief.

    As just about everybody predicted it doesn't appear this is going to be settled anytime pre election.

    Maybe, just maybe, we'll get an
    It's Fucking Obvious
    ruling that the POTUS, current or past, can not commit illegal acts against the US. And said person can be prosecuted with no claim of immunity.

    We're going to end up with some kind of BS ruling saying immunity should be determined on a case-by-case basis. A decision which will be announced after the 2024 election.

    How in the hell did these unethical judges make it onto SCOTUS? That's a rhetorical question, there is an abundance of articles explaining how this happened.

    Uhh, great way for a supreme court justice to act.
    And yet another wife that's an extremist and active. (like Thomas' wife)
    I wonder if Gorsuch's wife is going to explode next?? :rolleyes:

    It's obvious that Alito is biased beyond appropriate.
    And he will not vote fair on any Jan 6th or Chump case. (much less anything that is influenced by his militant views...yes, he IS hostile, we've seen it)

    And it's unlikely he would ever recuse himself. Too arrogant and self-righteous.

    What is Chief Justice John Roberts doing? We know the SC loves to operate in secrecy...even when the entire populace of the US absolutely deserves to know what our highest court is doing.

    Oh, no conflict of interest there... :rolleyes:
    At least they're making the argument obvious for the meeting with Roberts.
    But really, there's nothing Roberts can do...he's simply "first among equals" :(
    And Alito is bonkers enough to press forward to do what he wants...then just rationalize it.

    BUT, there may be an out...figured out by a Constitutional scholar,

    Question is, are Biden and the Dems bold enough to try for it??
    There isn't much time, they've got to act quick.
    SCOTUS year is ending soon.

    And the DOJ Merrick Garland isn't known for being fast. :oops:

    This would be great.

    If action is taken now/very soon, the Supremes won't rule on presidential immunity until after the election. Possibly never depending on how the election turns out.

    If it could be enforced quickly...no, I don't see that happening. The SC has already shown resistance when challenged, they would find a way to drag this out for basically as long as they want.

    Tortoise Garland do something quickly? Only if other people in the DOJ have pre-prepared for this action should someone decide to move on it.

    If y'all think I've been optimistic about the election, I'm not so about the Supremes. I'm not certain that anything happens there unless the Dems convincingly win the White House and both houses of Congress, expand the court, and those justices immediately use their majority to pass sweeping, comprehensive ethics reform.

    I think it's either that or guillotines or 30 years.

    Let's face it. 3-5 of the Justices are blatantly corrupt.

    First, I'm a little shocked by the high amount he actually disclosed (did he?). It seems to me that high amount would a red flag that Thomas is a Gratuity Accepted justice who probably isn't reporting everything.


    I see both houses remaining split enough to prevent loading the SC. And of course any Executive Order to do so would be heard by, and shot down by, the SC.

    We would very likely need another 16 years of sanity in the White House to get the SC back to some kind of sanity. And support in the Senate would be necessary (remember how McConnell screwed Obama out of making a SC justice appointment).
