On the way home from work tonight, NPR (or OPB?) focused on invetors putting $$ into the future of the marijuana industry, in particular in WA state. (However, that begs a whole 'nother post for those hungry to make it to Tilted Exhibition -- look forward to some future post re feds vs states, 0r maybe there already is one.)

Here is that post! How can it be that state vs fed rules differ? I remember the case in SF during the Asscroft, excuse me, I meant to say fuckin asscroft, era when jurors were polled after a plantiff was found guilty. The fed judge forbid evidence of state licensing to be told to jurors because it was not pertinent to a fed case, and when exit polled by the media, every single juror said they would have judged differently if they had been given that info. I imagine it was appealed and I never did research any further outcome, but it seems unfair to voters, doesnt it?

Im not sure where I stand on legalization, and I really dont promote the stuff, but the double standard scares the hell out of me.

Again, the currentresidenthippiechick, and happy to accomodate for now!

KirStang is, in fact, a lawyer and knows the difference between federal and state laws.

That's a constant stress in the United STATES of America.

That overlap between the state and the federation, is endlessly fascinating to me.

Thank you! This was my first thought. Supremacy Clause...duh. They can choose not to enforce, which is what seems to be happening so far.

Your 8th grade teacher or your civics teacher failed you, girldetective.

And a matter of fact, they have...
While the Obama administration is doing lighter push, it does enforce it and it still he is not expecting to push for a change.
It is dependent on the aggressiveness of the bureaucrat, the prosecutor and the extent/actions of your activities.

Hell, they've even recently gone after certain medical distributaries.
